Terms of Service

Important: These Terms apply across Bangladesh, India, Nepal, Brazil, and Bhutan.

1. Introduction

Welcome to Amaniq ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our loan management software, website, and related services (collectively, the "Service") across multiple jurisdictions including Bangladesh, India, Nepal, Brazil, and Bhutan. By accessing or using the Service, you agree to be legally bound by these Terms.

2. Nature of Service (SaaS Platform)

We act strictly as a software service provider (SaaS platform):

  • We do NOT provide financial, legal, investment, tax, or business advice
  • We do NOT participate in transactions between users
  • We do NOT guarantee outcomes, profits, or performance
  • We do NOT act as an intermediary, broker, or agent

Users are solely responsible for how they use the software.

3. Free Trial & Subscription

Free Trial Period: 15 Days
New users receive a 15-day free trial with full access to all features. No charges during this period.
  • After 15 days, you must purchase a subscription plan to continue using the Service
  • Upon payment approval, tenant control panel access is activated within 24 hours maximum
  • Subscription plans are available monthly and annually
  • All payments are non-refundable unless required by law

4. Account Expiration & Data Deletion

Data Retention Policy:
If your account remains unpaid for 1 month after expiration, your account and all associated data may be permanently deleted without prior notification or notice.
  • Renewal grace period: 30 days after subscription expiry
  • No refunds for partial months or unused time
  • Data export available upon request before deletion
  • We reserve the right to delete accounts inactive for 90+ days

5. User Responsibility

You agree that:

  • You will use the Service in compliance with all applicable laws in your country
  • You are fully responsible for: data entered, transactions conducted, compliance with local regulations
  • You will not use the platform for: illegal activities, fraud, money laundering, or unauthorized transactions
  • You will maintain accurate records of all transactions

6. No Liability Clause

To the maximum extent permitted by law:

  • We are NOT liable for: financial losses, business losses, data inaccuracies entered by users, third-party integrations or services
  • We do NOT guarantee: system uptime without interruption, error-free operation, accuracy of user-generated content

7. Third-Party Services

Our platform may integrate with third-party services (e.g., payment gateways, APIs, WhatsApp).

  • We do not control or take responsibility for third-party services
  • Any issues arising from third-party providers must be resolved with them directly

8. Data Usage & Privacy

  • We store and process data as per our Privacy Policy
  • Users are responsible for ensuring they have rights to upload/store data
  • All data is protected with 256-bit encryption
  • We use OTP verification and multi-layer security

9. Termination

We reserve the right to suspend or terminate accounts for:

  • Violation of these Terms
  • Suspicious or illegal activity
  • Non-payment after grace period
  • Fraudulent or harmful behavior

We may remove any data if required by law.

10. Jurisdiction & Governing Law

This agreement is structured to comply with multiple legal frameworks:

  • Bangladesh: ICT Act 2006, Digital Security Act 2018
  • India: Information Technology Act 2000, IT Rules 2021
  • Nepal: Electronic Transactions Act 2008
  • Brazil: LGPD (Lei Geral de Proteção de Dados)
  • Bhutan: Information, Communications and Media Act 2018

Users must comply with the laws applicable in their respective country.

11. Limitation of Liability

In no event shall we be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or data
  • Legal disputes arising between users and third parties

12. Indemnification

You agree to indemnify and hold us harmless from claims, legal actions, and damages arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service means acceptance of updated Terms. Material changes will be notified via email.

14. No Advisory Disclaimer

Important Disclaimer:
We explicitly state that we do NOT provide financial, legal, or professional advice. We are only a software tool provider. Users must consult independent professionals for business, legal, and financial decisions.
